Unidentified and Unreported Federal Deficiencies in California's Complaint Surveys of Nursing Homes

When conducting complaint surveys of nursing homes from 2006 through 2008, the California Department of Public Health, Licensing and Certification Division (the Division), did not always identify and report deficiencies for unmet Federal requirements related to those homes' participation in the Medicare and Medicaid programs. Contrary to Federal requirements, for 24 of 47 complaint surveys at 3 nursing homes that we judgmentally selected, the Division did not identify and report 41 such deficiencies; instead, the Division cited only unmet State requirements.
