Leon Melohn, 149 Ballston Ave LLC, and Ballston Two, LLC Agreed to Be Excluded for 10 Years for Installing Unlicensed Operators Who Oversaw the Provision of Worthless Services

On February 27, 2023, in connection with the resolution of their False Claims Act liability, Leon Melohn (Melohn), 149 Ballston Ave LLC (149 Ballston), Ballston Two, LLC (Ballston Two), New York, agreed to be excluded under 42 U.S.C. 1320a-7(b)(7) and 42 U.S.C. 1320a-7(b)(6)(B) for 10 years. The investigation revealed and OIG alleged that Melohn, 149 Balston, and Ballston Two were the real property owners and landlords of Saratoga Center for Rehabilitation and Skilled Nursing Care (Saratoga Center), a skilled nursing facility located at 149 Ballston Ave., Ballston Spa, New York. Melohn, 149 Balston, and Ballston Two entered into a revolving line of credit and security agreement with the licensed operators of Saratoga Center to provide working capital for the facility; subsequently, when the licensed operators defaulted on that agreement, Melohn, 149 Ballson, and Ballston Two required the licensed operators to relinquish control of Saratoga Center to unlicensed operators who oversaw the provision of worthless services to residents. OIG further alleged that Melohn, 149 Balston, and Ballston Two caused the submission of false and fraudulent claims to Medicaid for worthless services from February 17, 2017 through the facility’s closure in February 2021.
