Labtech Diagnostics and Joseph Labash Agreed to Be Excluded for Allegedly Paying Improper Remuneration

On December 19, 2025, in connection with the resolution of their False Claims Act liability, LTD Holding, LLC f/k/a Labtech Diagnostics (Labtech), Anderson, South Carolina, and Joseph Labash (Labash), agreed to be excluded from participation in all Federal health care programs under 42 U.S.C. 1320a-7(b)(7). Labtech agreed to be excluded for five years, and Labash agreed to be excluded for three years. The investigation revealed and OIG alleged that Labtech and Labash: (1) paid healthcare providers (HCPs) remuneration disguised as purported office space rental, phlebotomy, and toxicology payments, in return for the HCPs’ referrals to Labtech for clinical laboratory services; (2) arranged to pay a physician practice an amount in excess of fair market value for the practice’s used laboratory analyzer to secure the practice’s referrals of clinical laboratory services to Labtech; and (3) provided a pain management practice free services and supplies in connection with presumptive urine drug testing, in return for the pain practice referring its lucrative definitive urine drug testing.
