David Boguslavsky, MD and Premier Medical Acupuncture Agreed to Pay $581,000 for Allegedly Violating the Civil Monetary Penalties Law by Submitting Claims for Bundled Services that Included Drugs that Were Not Purchased

On September 24, 2025, David Boguslavsky MD (Dr. Boguslavsky) and PremierMD d/b/a Premier Medical Acupuncture (Premier), Bridgewater, New Jersey, entered into a $581,140.74 settlement agreement with OIG. The settlement agreement resolves allegations that Dr. Boguslavsky and Premier submitted claims to Medicare Part B, Medicare Part C, and Medicaid for the provision and administration of Spravato under HCPCS Codes G2082 and G2083 when they did not purchase the Spravato. Instead, specialty pharmacies delivered the Spravato to Premier and submitted claims for the Spravato to Medicare Part D and Medicaid.
