Robin Medical and Erez Nevo Agreed to Pay $250,000 for Allegedly Violating the Civil Monetary Penalties Law by Making Misrepresentations in NIH Grant Applications and Progress Reports

On June 9, 2023, Robin Medical, Inc. (Robin Medical) and Erez Nevo (Nevo), Baltimore, Maryland, entered into a $250,000 settlement agreement with OIG. The settlement agreement resolves allegations that Robin Medical and Nevo knowingly made, used, or caused to be made or used false statements in applications and progress reports required to be submitted in order to receive funds provided by the Secretary of HHS pursuant to National Institutes of Health (NIH) Small Business Innovation Research (SBIR) grants. Specifically, OIG alleged that Robin Medical and Nevo made representations in applications and progress reports for two NIH SBIR grants that: (1) all research and development on the projects would be performed in its entirety in the United States; (2) the research projects would not involve activities outside the United States or international collaborators; (3) there was no foreign component to the research and development; (4) no amount of the awards’ budgets were spent in a foreign country; and (5) the projects had no foreign performance sites. OIG contended these statements were false because some of the research and development on the NIH SBIR grants took place in Israel. Senior Counsels Michael Torrisi and James Hansen, assisted by Chief Investigator Amber Mahmood, represented OIG.
