Quivvy Tech Corporation, Reliable Document Solutions and Franklyn Michelin Agreed to Be Excluded for 25 Years for Allegedly Submitting and Causing the Submission of Medically Unnecessary Durable Medical Equipment and Pharmaceuticals
On May 16, 2025, in connection with the resolution of their False Claims Act liability, Quivvy Tech Corporation (Quivvy Tech), Reliable Document Solutions, LLC (Reliable) and Franklyn Michelin (Michelin) Boca Raton, Florida, agreed to be excluded under 42 U.S.C. 1320a-7(b)(7) for 25 years. The investigation revealed and OIG alleged that Quivvy Tech, Reliable, and Michelin submitted and caused to be submitted claims and statements to the Medicare program that were false due to (1) hiring and directing telemarketers to cold call lists of patients and target Medicare beneficiaries with deceptive sales practices that promoted the ordering and prescribing of medically unnecessary durable medical equipment and various medically unnecessary pharmaceuticals through scam telemedicine consultations; (2) contracting with and paying physicians to order and prescribe certain medically unnecessary durable medical equipment and medically unnecessary pharmaceuticals based on little or no patient interaction or medical evaluation; and (3) selling the resulting orders and prescriptions to DME suppliers and pharmacies, which were billed to Medicare.
