P.A.B. Pharmacy Agreed to Pay $551,000 for Allegedly Violating the Civil Monetary Penalties Law by Submitting Claims for Prescription Drugs Not Dispensed

On November 21, 2022, P.A.B. Pharmacy, Inc. (PAB Pharmacy), Brooklyn, New York, entered into a $551,549.20 settlement agreement with OIG. The settlement agreement resolves allegations that PAB Pharmacy submitted false claims to Medicare Part D for the following prescription drugs that it did not have in inventory and did not dispense: Prezista 600, Prezista 800, Atripla, and Isentress. OIG also alleged that PAB Pharmacy submitted a false claim to Medicare Part D for the prescription drug Descovy when it did not dispense the drug. Senior Counsels Gregory Becker and James Hansen, with the assistance of Chief Investigator Amber Mahmood, represented OIG.
