Mitchell Spivack and Verree Pharmacy Agreed to Be Excluded for 22 Years for Dispensing and Distributing Medically Unnecessary Controlled Substances
On August 11, 2022, in connection with the resolution of their False Claims Act liability, Michael Spivack (Spivack), Huntington Valley, Pennsylvania, and Spivack, Inc. d/b/a Verree Pharmacy (Verree Pharmacy), Philadelphia, Pennsylvania, agreed to be excluded for 22 years. Spivack was excluded under 42 U.S.C. 1320a-7a and 42 U.S.C. 1320a-7(b)(7) and Verree Pharmacy was excluded under 42 U.S.C. 1320a-7(b)(7). The investigation revealed and OIG alleged that Spivack and Verree Pharmacy: (1) unlawfully dispensed and distributed controlled substances in violation of the Controlled Substances Act and (2) knowingly presented and caused the presentation of false and fraudulent claims to the United States, for drugs not dispensed to Federal health care program beneficiaries, and for controlled substances dispensed in violation of the Controlled Substances Act.
