Lafferty Enterprises and Paul Lafferty Agreed to Pay $172,000 for Allegedly Violating the Civil Monetary Penalties Law by Failing to Return CARES Act Provider Relief Funds

On May 1, 2023, Lafferty Enterprises Inc. (Lafferty Enterprises) and Paul Lafferty, Prestonsburg, Kentucky, entered into a $172,243.53 settlement agreement with OIG. The settlement agreement resolves allegations that Lafferty Enterprises and Paul Lafferty knowingly and improperly avoided an obligation to pay or transmit funds to the Secretary of HHS. Specifically, OIG contends that on April 10, 2020, Lafferty Enterprises received a Provider Relief Fund payment pursuant to the CARES Act. Lafferty Enterprises was not eligible to retain this payment because it did not provide after January 31, 2020, diagnoses, testing, or care for individuals with possible or actual cases of COVID-19, yet Lafferty Enterprises and Paul Lafferty did not return the payment. Senior Counsel Michael Torrisi, assisted by Chief Investigator Amber Mahmood and Program Analyst Mariel Filtz, represented OIG.
