Exactech Agrees to Pay $8 Million to Resolve False Claims Act Allegations for Selling Defective Knee Implant Devices
Baltimore, Maryland – Exactech Inc. agreed to pay $8 million to resolve allegations that the company violated the federal False Claims Act. A medical device company based in Gainesville, Florida, Exactech allegedly violated the False Claims Act by knowingly submitting or causing the submission of false claims for payment to Medicare, Medicaid, and the United States Department of Veterans Affairs (VA) in connection with defective knee-replacement devices.
Heightened Scrutiny
Although Exactech, Inc. entered into a health care fraud settlement with the United States, Exactech refused to agree to compliance-related oversight with HHS-OIG through a CIA. Therefore, as part of the Settlement Agreement, OIG reserved the right to exclude Exactech for the alleged conduct. Because Exactech refused appropriate integrity obligations, OIG may use various tools to monitor Exactech’s compliance with the Federal health care programs.
