Dr. Vinay Malviya and Vinay Malviya, MD, PC Agreed to Be Excluded for 3 Years for Causing the Submission of False Claims for Medically Unnecessary Services

On April 6, 2022, in connection with the resolution of their False Claims Act liability, Vinay Malviya, MD and Vinay K. Malviya, MD PC, (collectively, “Dr. Malviya”), Bloomfield Hills, Michigan, agreed to be excluded under 42 U.S.C. 1320a-7(b)(7) for three years.  The investigation revealed and OIG alleged that Dr. Malviya caused the submission of false claims for payment to Federal health care programs related to: (1) medical radical hysterectomies and radical hysterectomies that Dr. Malviya performed when only simple hysterectomies were medically necessary; (2) chemotherapy services that Dr. Malviya administered or ordered that were in excess of what was medically necessary; and (3) evaluation and management services by Dr. Malviya that were not performed or not rendered as represented.
