Dr. David Kaner and Kaner Medical Group Agreed to Pay $94,000 for Allegedly Violating the Civil Monetary Penalties Law by Receiving Remuneration in the Form of Process and Handling Payments

On July 13, 2021, David B. Kaner, D.O. (Dr. Kaner), and Kaner Medical Group (Kaner Medical), Bedford, Texas, entered into a $94,440 settlement agreement with OIG.  The settlement agreement resolves allegations that Dr. Kaner and Kaner Medical solicited and received remuneration from laboratory company Health Diagnostic Laboratory, Inc. (HDL), in the form of "process and handling" payments related to the collection of blood. OIG alleged that Dr. Kaner and Kaner Medical solicited and received the remuneration from HDL in exchange for Dr. Kaner and Kaner Medical employees referring patients for laboratory testing services to HDL, for which the Medicare program paid. Senior Counsels Katie Fink and Jennifer Leonardis represented OIG with the assistance of Program Analyst Mariel Filtz.
