Carla Sparkler Agreed to Be Excluded for 6 Years for Allegedly Paying Improper Remuneration

On February 9, 2024, in connection with the resolution of her False Claims Act liability, Carla Sparkler, former Chief Marketing Officer of BioTek reMEDys Inc. (BioTek), located in New Castle, Delaware, agreed to be excluded under 42 U.S.C. 1320a-7(b)(7) for six years.  The investigation revealed and OIG alleged that Sparkler through BioTek: (1) waived patient copays to allegedly induce patient referrals; and (2) allegedly paid kickbacks, including meals, tickets, gifts, and free practice management and clinical support services, to physicians, in exchange for referring patients to BioTek.  Senior Counsel Sandra Sands represented OIG.
