Ari Schwartz and Saratoga Center for Care Agreed to Be Excluded for 10 Years for Making Misrepresentations to Obtain an Operating Certificate and Causing the Submission of False Claims for Worthless Services

On February 27, 2023, in connection with the resolution of their False Claims Act liability, Alan “Ari” Schwartz (Schwartz) and Saratoga Center for Care LLC (SCC), New York, agreed to be excluded under 42 U.S.C. 1320a-7(b)(7) and 42 U.S.C. 1320a-7(b)(6)(B) for 10 years. The investigation revealed and OIG alleged that Schwartz and SCC submitted or caused the submission of false claims to Medicaid: (1) when they made misrepresentations in 2014 to obtain a license from the New York State Department of Health (NYSDOH) to operate Saratoga Center for Rehabilitation and Skilled Nursing Care LLC (Saratoga Center) located at 149 Ballston Ave., Ballston Spa, New York; (2) when they surrendered control of Saratoga Center to unlicensed operators without notifying NYSDOH; and (3) as a result of worthless services provided to residents of Saratoga Center from February 2017 through the facility’s closure in February 2021.
