Alan Harley, Joan Harley and Central Medical Systems Agreed to Be Excluded for Submitting False Claims for Wound Care Supplies

On November 1, 2021, in connection with the resolution of their False Claims Act liability, Alan Harley was excluded under 42 U.S.C. 1320a-7(b)(7) and 42 U.S.C. 1320a-7(a)(1) for 15 years. Joan Harley and Central Medical Systems, LLC (CMSI) also agreed to be excluded under 42 U.S.C. 1320a-7(b)(7) for five years and 15 years respectively. The investigation revealed and OIG alleged that CMSI submitted false claims for surgical dressings and wound care supplies at a higher paying code than allowed and submitted claims for items not provided to patients, specifically by billing Medicare for greater quantities of items than were provided to patients. OIG also alleged that CMSI along with Alan and Joan Harley, Meddex Solutions, LLC (Meddex), and Arthur Wright submitted claims for payment to Medicare via Meddex that in fact were claims for patients of CMSI. Arthur Wright and Meddex were also excluded by a separate agreement for three years. Senior Counsel Karen Glassman represented OIG.
